How Can I File a DMCA Counter Notification?

If Unchained Music notifies you that one of your releases has received a DMCA takedown request or claim and you believe this claim is invalid, you have the legal right to file a DMCA Counter Notification (also known as a Counter-Claim) under U.S. copyright law.

This process allows you to challenge the takedown and potentially have your content reinstated, provided you can demonstrate legitimate ownership of the material.

⚠️ Important Notes Before Filing

  • This is a legal escalation. Filing a DMCA counter notification signals that you’re ready to defend your ownership in court if challenged.
  • You must be the copyright owner (or authorized representative) to file.
  • You must include all required information and incomplete submissions will not be valid.
  • You should only file if you can prove ownership with relevant documentation.

How Do I Submit a DMCA Counter Notification?

  1. Send your counter-notification via email
    Email the claimant directly and CC Unchained Music at support@unchainedmusic.io.
  2. Include the exact text and information below
    Be sure to fill in your information accurately.

Sample DMCA Counter Notification Email Template

I am writing to avail myself of my rights under the Digital Millennium Copyright Act (DMCA). You recently provided me with a copy of a Notice of Infringement from [Insert Claimant's Name]. This letter is a Counter-Notification as authorized under § 512(g) of the U.S. Copyright Law.

I have a good faith belief that the material was removed or disabled due to a mistake or misidentification. I, therefore, request that the material be reinstated and/or no longer disabled.

You are registered with the U.S. Copyright Office as the Designated Agent for this platform.

1. The material in question is:
[Release Title and Track Name]
[Artist Name]
[UPC(s) and ISRC(s), if available]

2. My contact information is:
[Full Legal Name]
[Company Name, if applicable]

3. Jurisdiction statement (choose the correct version below):

If you are located in the U.S.:
I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, and I agree to accept service of process from the person who submitted the Notice of Infringement.

If you are located outside the U.S.:
I consent to the jurisdiction of any Federal District Court in the U.S., and I agree to accept service of process from the person who submitted the Notice of Infringement.

4. Statement of good faith:
I have a good faith belief that the material was removed or disabled because of a mistake or misidentification. I request that the material be reinstated and/or no longer disabled.

I declare under penalty of perjury under the laws of the United States of America that this notification is true and correct.

What Happens Next?

  • Once the claimant receives your counter-notification, they have 10 business days to file a lawsuit against you and notify Unchained Music.
  • If they don’t respond within that time, your content will be eligible for reinstatement.
  • Be aware that not all DSPs follow DMCA procedures equally, but filing a valid counter-notification is still a best practice for protecting your rights.
